Whether it's to raise further finance or to take advantage of a better mortgage deal with another lender, at Widdows Mason we appreciate that once you have decided to remortgage, you want to get on with it without delay so that you can benefit from your new arrangement as soon as possible.

If you require any further services from us, then this work can usually be carried out at the same time as your remortgage. Further services can include:

  • Transfers of Equity
  • Deeds of Postponement

Transfer of Equity

If you currently co-own your property with one or more other owners, and you wish to either transfer your interest in the property to the other owners, or to buy out their share in the property, then this is known as a Transfer of Equity. We can prepare the necessary documentation on your behalf and arrange for the transfer to be registered at the Land Registry. In certain circumstances you can liable for the payment of Stamp Duty Land Tax and we will of course advise you should your transaction be liable in this way.

Deed of Postponement

You might already have more than one legal charge registered against your property but do not wish to pay off all the legal charges at the same time.

When this situation arises your new lender will undoubtedly wish to acquire a First Legal Charge against your property. It will be necessary for you to seek the consent of all parties to ensure that this will be possible and for a Deed of Postponement to be signed by all the parties concerned and registered at the Land Registry.

Leases and Tenancy Agreements

Leases and tenancy agreements cover a wide range of situations and can vary from medium term leases of commercial premises such as department stores, office blocks, and factory premises, to shorter term leases of shops and offices, domestic leases for the letting of a house, short term tenancy agreements, agricultural tenancies, tenancies of allotment gardens and even licences to occupy.

The Law relating to landlord and tenant in both business and domestic properties is complex and the regulations relating to them must be strictly observed if the clients interests are to be best protected.

We can advise and prepare leases and tenancy agreements for you whether you are a landlord or a tenant, deal with rent reviews, renewals, claims for dilapidations, proceedings for possession, arrears of rent, breaches of covenant, for example to repair and insure, or to use only in a specified manner, and generally advise you on all aspects of your lease or tenancy agreement.

Commercial Conveyancing
